🏡 DID YOU KNOW? | HUUR GAAT VOOR KOOP

In South African property law, “Huur Gaat Voor Koop” means that a lease generally takes precedence over the sale of a property.

📌 What does this mean?

If a landlord sells a property with an existing tenant, the sale does not automatically terminate the lease.

✅ The purchaser becomes the new landlord upon transfer.
✅ The existing lease generally remains valid.
✅ The tenant retains their rights under the lease.
✅ The new owner takes over the landlord’s rights and obligations.

⚠️ IMPORTANT FOR AGENTS:

Never promise a purchaser vacant occupation without first checking the existing lease agreement and the tenant’s rights.

Always disclose existing tenancies to potential purchasers and ensure the OTP addresses the tenancy and occupation arrangements.

Remember, certain lease clauses and legal provisions may affect termination rights.

💬 “At least you got something.”

A tenant said this to me today after making a payment towards the current rental amount due, as well as outstanding rent that had been short-paid the previous month.

And it got me thinking… this is something worth talking about.

🏡 Paying rent is not doing your landlord a favour.

Rent is a contractual obligation. When your lease specifies the rental amount and payment date, the full amount is due — and any amount short-paid remains outstanding.

Landlords have financial obligations too. Bond repayments, levies, rates, insurance, maintenance and other property-related expenses don’t disappear because the rent wasn’t paid in full.

Of course, life happens and people can experience genuine financial difficulties. That’s why early and honest communication is so important.

A good landlord-tenant relationship works both ways:
🤝 Tenants honour their lease and payment obligations.
🤝 Landlords honour their obligations.
🤝 Both parties communicate respectfully when there is a problem.

Paying an outstanding rental amount isn’t doing the landlord a favour — it’s settling money already due in terms of the lease agreement.

Respect. Communication. Accountability. They matter on both sides of a rental relationship.

💡🏡 BUYER EDUCATION: PRE-QUALIFIED VS PRE-APPROVED

Ready to start house hunting? Before you fall in love with a property, it helps to know what you may realistically be able to afford.

But what’s the difference between being pre-qualified and pre-approved?

🔹 Pre-qualified
This is generally an initial indication of what you may be able to afford, based on the financial information you provide.

🔹 Pre-approved
This usually involves a more detailed assessment of your income, expenses and credit profile by a bond originator or lender, giving you a stronger indication of the home-loan amount you may qualify for.

Neither is a guarantee that a home loan will ultimately be granted — final approval is still subject to the lender’s requirements and assessment of the application and property.
