I had hoped staying silent was taking the high road. But Jennifer's relentlessly detailed public "hypotheticals"—which are clearly directed at me—are no longer just hypothetical questions. She has posed identical statements to me via email. These are extraordinarily serious allegations, apparently intended to discredit me while deflecting from a valid six-figure breach-of-contract claim. A few documented facts are worth addressing:
• Dragging a good man and his grieving family into her dispute with me is DISGUSTING. Kenny and I contemplated an ownership arrangement in exchange for a substantial contribution of materials and labor. Those contributions were never made, and we mutually agreed to terminate the entire arrangement, including the contemplated ownership interest, before his passing. We parted on GOOD TERMS and even discussed working together on future unrelated endeavors. His passing was so devastating for everyone who knew him. He was a friend then, and he would be my friend today if he was still here. I really can't articulate what a rad dude he was to anyone who didn't already know him. To the best of my knowledge, Jennifer never met him and does not know him.
• The corporate consent she is sensationalizing concerned a separate nonprofit association that was formed solely for TABC compliance. It did not concern the LLC. I have supporting documentation regarding all of this, including the contemplated arrangement and the absence of the required investment with the LLC, and I find the attempt to exploit his tragic death to advance her wacky theories absolutely abhorrent. I will not address this again or dignify the insinuations surrounding his passing by turning his personal circumstances into a public spectacle. Her desperation level and vindictiveness is off the rails for her to distort the relationship and friendship I had with Kenny as she has – which is WILDLY inappropriate. If Kenny’s family is reading this: please reach out to me privately if you want clarity. I am truly sorry from the bottom of my heart that she has involved you in our personal contract dispute and I want to put your minds at ease.
• My two former “business partners”: Their proposed ownership arrangement was conditional and never came to fruition. Our agreement was terminated following documented breaches. It was not pretty. But contrary to Jennifer's allegations, BOTH WOMEN WERE PUT ON PAYROLL even though our arrangement documented that NONE of us would take payment or profits. I have the payroll records.
• The business was funded overwhelmingly through MY personal investment and credit line. Neither one of those women could even tell you how much was spent to open the restaurant because they didn't come out of pocket for any purchases or renovations after we met. I also allowed one of them to enter the building at the end of our relationship and take boxes I had packed with their personal effects, as well as look around and retrieve additional kitchen tools, a portable Bluetooth speaker, two refrigerators, and more. I still have the video security evidence documenting what was removed, including items whose removal I dispute. What little equipment was furnished by these women was documented as being furnished to the business effort without reimbursement. If I recall correctly, only a few items worth a few hundred dollars were left with the business at termination, either way, under our contract: they stayed with the business. Dragging them into this dispute is also in very poor taste.
• Jennifer's contracts: She signed 3 agreements with me, including a lease and two purchase-related agreements. Once executed, THE TERMS OF THOSE AGREEMENTS NEVER CHANGED. Subsequent discussions about purchasing different combinations of real estate were just that—discussions-and yes the numbers for these discussions changed a few times, but there were NEVER changes to our signed agreements. No amendments, no restatements, nothing.
• The Lease and Money: I set her rent at $1/month because I genuinely wanted her to succeed and be able to pay on the OTHER agreement. She couldn't even muster the wherewithal to pay the flippin' rent. Nor did she pay the $100,000 contractually due. Not one cent toward either obligation for 15 months. ALL DOCUMENTED.
• Re. her alleged “every intention” to purchase: On August 31--just ~24 hours before our contractual closing deadline that never transpired, she told Judge Parker: "…we decided we're not going to purchase the property, and we’re going to vacate September 1st." If she was planning to vacate, when was she going to provide me notice? I'll let y'all reconcile the above statement intending to vacate with her newly professed "every intention" to purchase. Those are HER words. And they're documented ON VIDEO.
• And why am I to blame for her alleged lost profits when our SIGNED agreement expressly required her to relinquish ALL NET PROFITS from the business each month toward satisfying her $100,000 contractual obligation that went unpaid? Whatever may have been "lost" was supposed to go toward our agreement anyway...
• The court ruling: A writ of reentry addresses possession of the premises—not final ownership or title to disputed business assets. The hearing occurred August 31, the FINAL DAY of Jennifer's lease, which was never renewed. When she asked Judge Parker to extend her lease an additional six days, he declined and expressly instructed her to retrieve her items and remove them from the building that day. This is documented ON VIDEO. My concerns regarding the hearing extend well beyond disagreement with the ruling and are being addressed through the appropriate channels.
• The “hypothetical” pattern of criminal conduct: These were separate business arrangements, with entirely different facts, terms, and outcomes. Jennifer was a party to OUR transaction only. Jennifer was NEVER a party to these prior arrangements, and is making extraordinarily serious insinuations -based on incomplete information- that are absolutely worthy of a defamation lawsuit. I have documentation to refute all of her nonsensical theories. She has wild speculation dressed up as "hypothetical" questions. Further, I consider this ongoing campaign of targeted social media posts blasted in groups from Tyler to Longview to be online harassment and bullying. Jennifer has publicly insinuated that I engaged in serious criminal conduct, while I have remained silent until now. I am preserving the evidence and expressly reserve my right to pursue any legal remedies available to me.
”We see things not as they are-but as we are.”
None of the “hypothetical” accusations being made against me are a reflection of me, despite her best efforts to push that narrative. Jennifer has not satisfied the $100,000 payment obligation under our signed agreement. Rather than addressing that obligation, she continues publicly challenging the authenticity and enforceability of our contracts.
I will not address this again, no matter how wild her theories get because I AM DONE with the public BS, but BEST believe I will be saving EVERY screen shot. I will not be intimidated by increasingly outrageous and offensive allegations tho. The documents, the payment records, and the video evidence literally(!) speak for themselves. I have all of it.
