When a buyer and seller enter into a purchase agreement, the seller takes the home off the market while the transaction moves through the entire process of closing. If the deal falls through, the seller must relist the house and start again. An EMD shows a seller that you have both the resources and the desire to 'seal the deal.'

The EMD protects the seller. If all goes smoothly, the earnest money is applied to the buyer's down payment or closing costs. If the buyer waives contingencies prematurely, ignores the timeline in the contract, or simply decides the home isn't "the one" and cancels without cause, the EMD will go to the seller.
