California businesses are now banned from using AI-powered surveillance tools to collect data on workers’ brain activity or infer their emotional states, under a law signed by Gov. Gavin Newsom (D).
The law restricts AI-enabled systems that can use video, audio, time-tracking, geolocation, or electromagnetic monitoring to collect neural data or recognize employees’ emotions.
The law comes as AI-powered workplace surveillance tools are expanding beyond tracking where and how long employees work to attempting to analyze biological and emotional signals.
Employers that violate the law can face civil penalties of up to $500 per violation, with enforcement handled by the state labor commissioner and public prosecutors.

Texas businesses and public-sector organizations: AI governance is no longer something to put on the “future” agenda.

Texas now has enforceable requirements governing how organizations develop, deploy, procure and use artificial intelligence.

Under the Texas Responsible Artificial Intelligence Governance Act, TRAIGA, organizations operating in Texas need to understand how their AI systems are being used and whether those uses create legal exposure, particularly when AI affects people, their rights or access to important opportunities and services.

For Texas state agencies and certain governmental entities, the requirements go even further. AI inventories, governance standards, employee awareness training, oversight and documentation are becoming part of the operating environment.

And this is bigger than ChatGPT.

If your organization uses AI for:

• Hiring, recruiting or employee decisions
• Lending or financial services
• Insurance
• Education or student services
• Housing
• Healthcare or essential services
• Customer profiling or automated decision-making
• Facial recognition, biometrics or behavioral analysis
• Generative AI used by employees
• AI-powered software purchased from third-party vendors

you should know what laws, policies and governance requirements apply to you.

The question is no longer, “Does our company use AI?”

The better questions are:

Where is AI being used?
Who is accountable for it?
What data is it using?
What decisions is it influencing?
What documentation do we have?
And could we demonstrate responsible governance if someone asked tomorrow?

I’ll be joining fellow industry professionals at The University of Texas at Arlington for the Employer Panel: AI in the Job Search on Tuesday, October 6. UTA’s official events calendar confirms the panel will run from 12:00–1:00 PM.

AI is already influencing what happens between “Submit Application” and “You’re hired.” But I want students to understand both sides of that equation.

We’ll be talking about how employers are using AI and Applicant Tracking Systems in hiring, how students can use AI strategically in their own job search, and where responsible AI use, human judgment, transparency and governance belong in that process.

As CEO of Panoramic Solutions Management, I spend a lot of time helping organizations understand what responsible AI adoption looks like. On October 6, I’m excited to bring some of that conversation directly to UTA students preparing to enter the workforce.
