It is respectfully submitted that the petitioner (wife) has instituted the present divorce proceedings after a short period of marriage, on the Bona fide apprehension of continued emotional and physical harm.
The petitioner states that within approximately 87 days of marriage, the respondent conduct has been marked by a consistent lack of respect, accompanied by verbal abuse and degrading behaviour. Such actions have caused serious mental distress and have undermined the foundation of the marital relationship.
The petitioner further submits that the Respondent's ongoing pattern of disrespect and abusive conduct gives rise to a reasonable and well-founded fear that such behaviour may escalate into physical violence in the future. The petitioner is not obligated to wait until actual physical harm occurs to seek legal protection.
In view of the above, the petitioner asserts that it is her legal right to seek dissolution of marriage on grounds of cruelty, emotional abuse and apprehension of further harm. The continuation of this marriage is neither safe nor sustainable for the petitioner.
Therefore, it is humbly prayed that this Hon'ble Court may be pleased to grant a decree of divorce in favor of the petitioner. In the interest of justice, safety and dignity.
