Customer agreement
🔻 TERMS AND CONDITIONS
1. **Service Agreement:**
By hiring (Steven Swales) KO Entertainment you agree to the terms and conditions outlined below.
2. **Booking and Payment:**
A non-refundable deposit of £30 is required to secure your booking. The remaining balance must be settled 14 days prior to the event date.
3. **Cancellation Policy:**
Cancellations made seven days or less before the event will result in forfeiture of the entire payment. Cancellations made 14 days or more in advance will receive a refund, minus the non-refundable deposit.
This includes all venues including care homes including Covid
4. **Event Details:**
The client is responsible for providing accurate event details, including date, time, and venue address. Changes to these details must be communicated and confirmed in writing at least seven days prior to the event.
5. **Equipment and Setup:**
The client must ensure the availability of adequate power supply and suitable space for the equipment setup. Any additional equipment requirements must be communicated well in advance.
6. **Performance Hours:**
The standard performance duration is 4 hours. Overtime may be negotiated at an additional fee, subject to the DJ's availability.
7. **Music Requests:**
The client may provide a list of preferred songs or genres in advance. The DJ will make reasonable efforts to accommodate these requests but retains the right to use professional judgment for song selection during the event.
8. **Conduct:**
The client is responsible for ensuring a safe and respectful environment for the DJ. Any behavior deemed inappropriate or threatening may result in the immediate termination of services without refund.
9. **Liability:**
KO Entertainment is not liable for any injury, loss, or damage to persons or property during the event. The client is responsible for the safety of guests and the security of belongings.
10. **Force Majeure:**
KO Entertainment is not liable for any failure or delay in performing its obligations due to circumstances beyond its control, including but not limited to acts of God, natural disasters, or government actions.
11. **Photography and Promotion:**
The client agrees that KO Entertainment may use photographs or videos from the event for promotional purposes, unless otherwise specified in writing.
12. **Termination:**
Either party may terminate this agreement with written notice if the other party breaches any material term and fails to remedy the breach within 7 days of receiving notice.
13. **Governing Law:**
This agreement is governed by the laws of [your jurisdiction]. Any disputes arising from or related to this agreement shall be resolved through arbitration in accordance with the rules of [chosen arbitration organization].
By proceeding with the booking, you acknowledge that you have read, understood, and agreed to these terms and conditions.
🔻 EQUIPMENT DAMAGE POLICY
1. **Client Responsibility:**
The client agrees to exercise due care and diligence in handling the equipment provided by KO Entertainment. The client is responsible for any damage to the equipment caused by negligence, misuse, or intentional actions.
2. **Equipment Inspection:**
Upon setup and before the commencement of the event, the client has the right to inspect all equipment provided by KO Entertainment. Any pre-existing damage should be documented and reported to the DJ immediately.
3. **Notification of Damage:**
In the event of equipment damage during the course of the event, the client must notify the DJ promptly. Delayed notifications may impact the ability to assess the cause and extent of the damage.
4. **Repair or Replacement Costs:**
The client is responsible for covering the cost of repairing or replacing any damaged equipment. The client agrees to pay the repair or replacement costs within 7 days of receiving an invoice from KO Entertainment.
5. **Assessment of Damage:**
KO Entertainment will conduct a fair and reasonable assessment of the damage. This assessment will be communicated to the client, including a breakdown of costs associated with repairs or replacements.
6. **Loss of Use:**
In addition to repair or replacement costs, the client may be liable for loss of use charges for the period during which the damaged equipment is unavailable for future bookings.
7. **Security Deposit:**
KO Entertainment may require a security deposit, separate from the booking fee, to cover potential equipment damage. This deposit will be refunded within 7 days after the event, minus any applicable deductions for damages.
8. **Intentional Damage:**
Any intentional damage to the equipment will result in immediate termination of services, and the client will be responsible for the full replacement value of the damaged items.
9. **Force Majeure:**
KO Entertainment is not liable for equipment damage caused by unforeseen events beyond its control, such as acts of God, natural disasters, or vandalism.
10. **Insurance:**
The client is encouraged to obtain event insurance that covers potential damages to the equipment. KO Entertainment is not responsible for any costs not covered by the client's insurance.
11. **Dispute Resolution:**
Any disputes related to equipment damage and associated costs shall be resolved through arbitration in accordance with the rules of [chosen arbitration organization].
By proceeding with the booking, you acknowledge that you have read, understood, and agreed to the terms and conditions, including the equipment damage policy outlined above.
