حقوق زوجین قرآن و سنّت کی روشنی میں پارٹ ٹو
جب باہم قلبی و ذہنی ہم آہنگی ہوگی تو اچھا اور عمدہ معاشرہ تشکیل پائے گا، کیوں کہ معاشرہ، معاشرت سے عبارت ہے۔ مرد کے حقوق سے مراد وہ ذمے داریاں ہیں جن کا بجا لانا، انہیں پورا کرنا عورت کے لیے لازم و ضروری ہے اور بیوی کے حقوق سے مراد وہ امور لازم و شرعی ہیں جن کا ملحوظ رکھنا مرد کے لیے لازم و ضروری ہے۔ اس لیے قرآن کریم میں انہیں ’’ایک دوسرے کا لباس‘‘ قرار دیا گیا ہے۔ یہ حقوق شرعی طور پر ایک دوسرے کے لیے ادائیگی فرائض کا درجہ رکھتے ہیں۔ کیوں کہ شرعاً و اخلاقاً وہ اس احکام پر عمل کے پابند ہیں، جو شریعت نے ایک دوسرے کے حق میں انہیں عطا کیے ہیں۔

شوہر کی اطاعت عورت پر قرآن و سنّت کے نصوص کے مطابق ہے اور مرد کے لیے عورت کی ذمے داری پورا کرنا عملاً، قولاً و فعلاً نصائص و سنّت پر عمل کرنا ہے۔ قرآن کریم ان عورتوں کی توصیف بہ ایں الفاظ کرتا ہے جو اپنے شوہر کے حقوق کی ادائیگی پر پورا اُترتی ہے۔ فرمان عالی شان کا مفہوم ہے: ’’جو عورتیں نیک ہیں وہ مردوں کے حکم پر چلتی ہیں اور ان کے عدم موجودی میں بہ حفاظت الٰہی (مال و آبرو) کی حفاظت کرتی ہیں۔‘‘ (النساء) اس حوالے سے حضرت ابُوہریرہ ؓ سے روایت ہے کہ حضور ﷺ نے فرمایا، مفہوم: ’’اگر میں کسی کے آگے سجدہ کرنے کا حکم دیتا تو عورتوں سے کہتا کہ وہ اپنے شوہروں کو سجدہ کریں۔‘‘ (ترمذی) اسی طرح حضرت ام سلمہؓ سے مروی ہے کہ حضور ﷺ نے فرمایا، مفہوم: ’’ہر عورت جو اس حال میں فوت ہوکہ اس کا خاوند اس سے راضی ہو تو وہ جنّت میں داخل ہوگی۔‘‘ (ترمذی)

عورت پر مرد کا یہ بھی حق ہے کہ وہ اپنے شوہر کی عدم موجودی میں اس کی امانت کی حفاظت کرے جو اس کے پاس ہے، یعنی اس کے نسب، آبرو، عزت و عظمت، مال و دولت، راز و نیاز، بچوں کی پرورش اس میں شامل ہے۔ ان عورتوں کے بارے میں جو شوہروں کی فرماں بردار ہیں، قرآن کریم میں فرمان عالی شان کا مفہوم ہے: ’’وہی عورتیں نیک ہیں جو اپنے مردوں کے حکم پر، ان کے کہنے پر چلیں اور ان کی عدم موجودی میں ان کے مال و آبرو کی حفاظت کریں۔‘‘ (النساء)

قرآن کریم نے اس لیے ’’حفظ الغیب‘‘ اور ’’حفظ اﷲ‘‘ کی اصطلاح استعمال کی ہے جو کہ نہایت وسیع المعنیٰ ہے۔ اسی طرح مردوں کے بارے میں حکم ہے کہ ان پر عورتوں کے حقوق لازم ہیں اور ان کے حقوق کیا ہے اس کی تشریح بھی بیان کی گئی ہے۔ قرآن کریم نے اسے تفصیلاً بیان فرمایا ہے۔

مثال کے طور پر معاشی، سماجی، تمدنی حقوق کے ساتھ گھر کی کفالت مرد کی ذمے داری ہے، وہ عورت کو سماج سے کاٹ کر نہیں رکھ سکتا اسے بھی معاشرتی و سماجی طور پر اپنے مقام کو منوانے کا حق حاصل ہے اور یہ مرد کی ذمے داری ہے کہ وہ اسے ایسے مواقع فراہم کرے، جس سے فائدہ اٹھا کر عورت حدود معاشرت میں اپنی فطری صلاحیتوں کو زیادہ سے زیادہ ترقی دے سکے اور تعمیر تمدن و تہذیب میں اپنے حصے کا کام بہتر طور پر سرانجام دے سکے۔

نیز یہ کہ ایسے مواقع میسر کرے کہ عورت کام یابی کے بلند تر مقام کو پہنچے، اس سے ناصرف معاشرہ بل کہ دین بھی ترقی کرے گا اور تخلیقی و سماجی میدان میں وسعت بھی پیدا ہوگی جو قوموں کے عروج کی علامت ہے۔ معاشرہ وہی ترقی کرتا ہے جہاں مرد و زن کو مساوی حقوق حاصل ہوں اور مذہب اسلام خواتین کی ترقی و کام یابی پر کوئی قدغن نہیں لگاتا، بہ شرط کہ وہ دائرہ اسلام اور حدود شرع میں ہو۔ عورت کے مساوی حقوق کے بارے میں یہ حدیث کریم بھی ہے۔ حضرت حکیم بن معاویہ ؓ اپنے والد سے راوی ہیں کہ انہوں نے حضور ﷺ سے عرض کیا: یا رسول اﷲ ﷺ! شوہر پر بیوی کا کیا حق ہے تو آپؐ نے فرمایا: ’’جب کھائے تو اسے کھلائے اور جب پہنے تو اسے پہنائے اور اس کے منہ پر نہ مارے اور اسے بُرا بھلا نہ کہے اور گھر کے سوا اس سے علیحدگی نہ اختیار کرے۔‘‘ (ابن ماجہ) یہ فرمان عالی شان قطرے میں سمندر رکھتا ہے اور اس کا عامل ہر طرح سے خوش حال زندگی بسر کرسکتا ہے، بہ شرطے کہ وہ صدق دل سے اس فرمان پر عمل پیرا ہوجائے۔

حضرت ابُوہریرہ ؓ سے روایت ہے کہ حضور ﷺ نے فرمایا، مفہوم: ’’مومنوں میں کامل ترین وہ ہے جو سب سے زیادہ حسن اخلاق والا ہو اور تم میں سب سے زیادہ بہتر وہ ہے جو اپنی عورتوں کے لیے بہتر ہے۔‘‘ (ابن ماجہ) حسن اخلاق، حسن سلوک کے بعد سب سے بڑا حق عورت کی آزادی یعنی اسے شوہر کے انتخاب اور شوہر کے ساتھ رہنے میں شریعت نے اختیار دیا ہے، انتخاب مرد میں بھی اس کی رائے کا احترام کیا ہے اور رفاقت میں اس کے جذبات کو پیش نظر رکھا ہے۔

اگر عورت گھر میں خود کو محبوس نہ سمجھے، گھر کو قید خانہ نہ جانے، گھریلو معاملات میں خود مختار اور باہمی مشاورت رکھتی ہو تو گھر کبھی نہیں بگڑے گا۔ اسلام نے عورت کو معاشی، سماجی اور تمدنی حقوق دے کر اس کی حیثیت کو مضبوط کردیا ہے، تاکہ معاشرے میں اس کی بھی عزت و وقار رہے اور وہ لوگوں کی دست برد سے بھی محفوظ رہے۔

اسلام عورت کی آزادی پر قدغن نہیں لگاتا مگر یہاں یہ بات بھی ذہن نشین رہے کہ اسلام میں عورت کی آزادی کا مطلب مغرب کی نام نہاد آزادی نسواں اور دیگر نسائی تحریکوں کی مادر پدر آزادی نہیں بل کہ اسلام کی عطا کردہ آزادی ان تمام خرافات سے پاک ہے۔ اس بے لگامی نے ہی مغرب سے خاندان کا تصور ختم کیا اور عورت کی عصمت کو برباد اور اس کی عزت کو تار تار کیا ہے۔ اسلام نے عورت کو ایسی آزادی سے مبرا و منزیٰ رکھا ہے اور اسے پاکیزہ تعلیم دیتا ہے جو کہ دین اسلام کا خاصہ ہے۔
