Denmark expands merger control to deals below regular thresholds.

What’s Going On? In their last two decisions, the Danish Competition and Consumer Authority (DCCA) exercised their new “call-in” power for the first time, and required notification of mergers that would previously fall outside purview.

Why Does It Matter? The Uber/Dantaxi case, called in after closing, and the OneMed/Kirstine Hardam case, both show an increased scrutiny (even after deal-closure) for all markets - even more traditional ones.

Key Takeaways: For companies engaged in M&A activities in Denmark or the EU, it is crucial to reassess competition risks early, regardless of deal size, and to plan for potential notification requirements and procedural delays.
